BallisticBid ("we," "our," or "us") is committed to protecting your privacy and ensuring the security of your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our firearms marketplace platform.

2. Information We Collect

Personal Information

  • Full legal name and date of birth
  • Government-issued identification details
  • Federal Firearms License (FFL) information (for dealers)
  • Contact information (email, phone number, mailing address)
  • Billing and shipping addresses
  • Payment information (processed securely through third-party providers)

Background Check Information

In compliance with federal and state laws, we facilitate background checks through licensed FFL dealers. We do not store NICS background check results but maintain records of transaction completion as required by law.

Transaction Data

  • Purchase and sale history
  • Bidding activity and auction participation
  • Product listings and descriptions
  • Communication between buyers and sellers

3. How We Use Your Information

We use your information to:

  • Facilitate legal firearms transactions between verified parties
  • Comply with federal, state, and local firearms regulations

8. Data Retention

We retain your information as required by federal firearms regulations. Transaction records are maintained for the period mandated by the ATF (currently 20 years for FFL records). Other personal information is retained as long as necessary to provide our services and comply with legal obligations.

9. Children's Privacy

Our platform is not intended for individuals under 18 years of age. We do not knowingly collect information from minors. Users must be at least 18 years old (21 for handgun purchases) to create an account.

10. California Residents (CCPA / CPRA)

This section applies if you are a California resident. Over the preceding 12 months, we have collected the categories of personal information identified in Section 2 ("Information We Collect") from you directly, from your activity on the platform, and from the service providers referenced in Section 5 ("How We Share Your Information"). We use that information for the business and commercial purposes described in Section 3.

Sale or Sharing of Personal Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We have not done so in the preceding 12 months. Because we do not sell or share personal information in this sense, we do not offer a "Do Not Sell or Share My Personal Information" control.

Your Rights

  • Right to know what personal information we collect, use, disclose, and retain about you.
  • Right to access a copy of the personal information we hold about you in a portable format.
  • Right to delete personal information we collected from you, subject to the legal retention requirements in Section 8.
  • Right to correct inaccurate personal information we maintain about you.
  • Right to limit the use and disclosure of sensitive personal information.
  • Right to non-discrimination — we will not deny service, charge different prices, or provide a lower quality of service because you exercised any of these rights.

How to Submit a Request

Submit a request using the "Account & Data Deletion" topic on our contact form at ballisticbid.com/contact, or email support@ballisticbid.com. An authorized agent may submit a request on your behalf with signed, written authorization; we may still verify your identity directly.

Verification

To protect your account and the information of others, we verify requests by matching identifiers in the request with information already on file (typically the email address of record and account details). For access or deletion, we may request additional verification commensurate with the sensitivity of the data involved.

Response Time

We will acknowledge your request within 10 business days and respond substantively within 45 calendar days, with one additional 45-day extension where reasonably necessary and permitted by law.

Retention Exceptions

Federal and state firearms regulations require us to retain certain transaction records (including ATF-mandated records and records supporting FFL transfers) for periods that can extend up to 20 years. If we cannot delete specific records in response to your request, we will explain what we retained and the legal basis for retaining it.

11. Other U.S. State Residents

Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), and other U.S. states with comprehensive consumer privacy laws have substantially the same rights described in Section 10, with state-specific variations. To exercise those rights, use the same submission methods listed under "How to Submit a Request" above.

12. International Users

Our services are intended for use within the United States only. International firearms transactions are subject to export/import regulations and are not facilitated through our platform.

13. Changes to This Policy

We may update this Privacy Policy to reflect changes in our practices or legal requirements. We will notify you of material changes via email or platform notification. Your continued use of our services after changes indicates acceptance of the updated policy.
