By accessing or using BallisticBid ("Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our Platform. These terms constitute a legally binding agreement between you and BallisticBid.

2. Eligibility and Account Requirements

Age Requirements

• You must be at least 18 years old to create an account
• You must be at least 18 years old to purchase rifles and shotguns
• You must be at least 21 years old to purchase handguns
• Age requirements may be higher based on your state and local laws

Legal Requirements

By using our Platform, you represent and warrant that:

• You are legally eligible to purchase and possess firearms under federal, state, and local laws
• You are not prohibited from owning firearms due to any criminal conviction, restraining order, or other legal restriction
• You will comply with all applicable laws regarding firearms purchases, transfers, and possession
• All information you provide is accurate, current, and complete

3. Firearms Transaction Requirements

Federal Firearms License (FFL) Transfers

ALL firearms transactions must be completed through a licensed Federal Firearms License (FFL) dealer. This includes:

• Background checks (NICS) as required by federal law
• Proper completion of ATF Form 4473
• Compliance with all waiting periods and state-specific requirements
• In-person pickup from an FFL dealer (no direct shipments to individuals)

Prohibited Items

The following items are prohibited on our Platform:

• Illegal firearms or destructive devices
• Fully automatic weapons without proper licensing
• Unregistered NFA items
• Ghost guns or unserialized firearms
• Firearms with obliterated serial numbers
• Any item prohibited by federal, state, or local law

4. User Responsibilities

Seller Obligations

• Provide accurate descriptions and images of all items
• Disclose any defects, modifications, or issues with firearms
• Ship only to valid FFL dealers
• Maintain required records of all transactions
• Comply with all applicable export/import regulations

Buyer Obligations

• Provide valid FFL dealer information for shipment
• Complete all required background checks and paperwork
• Comply with all state and local laws in your jurisdiction
• Pay all applicable taxes and fees
• Inspect items upon receipt at FFL dealer

5. Bidding and Auction Rules

• All bids are binding legal obligations to purchase
• Bid retractions are only allowed in cases of clear error
• Shill bidding (fake bids to inflate prices) is strictly prohibited
• Bid manipulation or interference with auctions will result in immediate account termination
• Reserve prices must be clearly disclosed
• Auction end times are final and non-negotiable

6. Fees and Payment

Platform Fees

• Listing fees (if applicable)
• Final value fees on completed sales
• Premium membership fees (optional)
• Payment processing fees

Payment Terms

All payments must be completed through our approved payment systems. Direct payments between users outside the Platform are prohibited and may result in account suspension.

7. Dispute Resolution

In the event of a dispute between users:

• First attempt resolution through our customer support team
• Provide all relevant documentation and evidence
• Cooperate with our investigation process
• Accept binding arbitration for unresolved disputes

8. Prohibited Conduct

Users are prohibited from:

• Straw purchases (buying firearms for prohibited persons)
• Providing false information or documentation
• Circumventing background check requirements

• Attempting to hack or compromise Platform security
• Creating multiple accounts to evade restrictions
• Posting content that promotes violence or illegal activities

9. Intellectual Property

All content on the Platform, including logos, text, images, and software, is the property of BallisticBid or its licensors. Users grant us a license to use any content they post for Platform operations and marketing purposes.

10. Disclaimers and Limitations of Liability

Platform Disclaimer

BallisticBid is a marketplace platform that facilitates transactions between independent parties. We are not a party to transactions and do not take possession of firearms. The Platform is provided "AS IS" without warranties of any kind.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALLISTICBID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless BallisticBid, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms of Service
• Your violation of any law or regulation
• Your use of the Platform
• Any transaction you conduct through the Platform
• Any content you post or transmit

12. Account Termination

We reserve the right to suspend or terminate accounts for:

• Violation of these Terms of Service
• Illegal or fraudulent activity
• Multiple user complaints
• Non-payment of fees
• At our sole discretion for any reason

13. Compliance with Laws

Users are solely responsible for compliance with all applicable laws, including but not limited to:

• National Firearms Act (NFA)
• Gun Control Act of 1968
• Brady Handgun Violence Prevention Act
• State and local firearms laws
• Export Administration Regulations (EAR)
• International Traffic in Arms Regulations (ITAR)

14. Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

15. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be notified via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the modified terms.
